Gymshark Build Your Wishlist Giveaway Terms & Conditions

Build your wishlist for a chance to win one of five £500 Gymshark gift cards (*or local currency equivalent as set out below). Add to your wishlist between 09:00 (GMT) on Friday 15 November 2024 and 09:00 (GMT) Thursday 21 November 2024 to be automatically entered into the giveaway. See T&C’s below.

By taking part in this giveaway, you agree to be bound by these terms and conditions. If you do not agree with any of these terms and conditions, then you should not take part in this giveaway.

1. THE GIVEAWAY

1.1 The promoter is Gymshark Ltd of GSHQ Blythe Valley Park, 3 Central Boulevard, Solihull, United Kingdom, B90 8AB (“we”, “us”, “our”).

1.2 The giveaway is free to enter and no purchase is necessary.

1.3 Only one entry will be accepted per person. Multiple entries from the same person will be disqualified.

1.4 This giveaway is in no way sponsored, endorsed, administered by or associated with any social media platforms on which this giveaway is advertised and by participating in this giveaway you agree to a complete release of these social media platforms from any claims arising out of or in connection with this giveaway.

2. HOW TO ENTER

2.1 To enter the giveaway, you must have:

2.1.1 downloaded the Gymshark app prior to 09:00 (GMT) Thursday 21 November 2024;

2.1.2 created a Gymshark account prior to 09:00 (GMT) Thursday 21 November 2024; and

2.1.3 added at least one item to your wishlist between 09:00 (GMT) on Friday 15 November 2024 (“opening date”) and 09:00 (GMT) Thursday 21 November 2024 (“closing date”).

2.2 Existing customers who have already downloaded the Gymshark app and created a Gymshark account before the opening date are eligible to participate in this giveaway, provided they meet the wishlist requirement within the specified dates.

2.3 Entries that are late, lost, delayed, misdirected, incomplete or cannot be delivered or entered for a technical or other reason will not be accepted.

3. ELIGIBILITY

3.1 Entrants must be aged 18 years or over to participate in the giveaway. We reserve the right to ask any winner to provide proof of age.

3.2 Our employees (and their immediate family) and those of our group companies, or anyone directly associated with us or the administration of the giveaway, are not eligible to enter the giveaway.

3.3 Entrants must have a valid email address to participate in the giveaway.

3.4 Entrants must also reside within countries eligible to receive deliveries from us – if you reside within a country in which we cannot deliver, you are ineligible to participate in the giveaway. You can find this information here.

3.5 In entering the giveaway, you confirm that you are eligible to do so and eligible to claim any prize you may win.

3.6 We reserve all rights (at our sole discretion) to decide if the eligibility criteria are met and/or to disqualify you from the giveaway and remove your entry post if: (i) your conduct is contrary to the spirit or intention of the giveaway, or (ii) in our opinion you've breached any of these terms and conditions.

4. PRIZE

4.1 Five randomly selected winners will receive a Gymshark gift card (in the form of a digital code) up to the value of £500 (five hundred pounds sterling) or *local currency equivalent if the winner resides outside of the UK.

4.2 Odds of winning will depend on the number of entries received.

4.3 The winners should allow up to 30 days for delivery of their gift card by email.

4.4 The prize is subject to winner confirmation (i.e. we can contact the winner and can confirm eligibility). The winner must also provide us with their full name, a valid postal address and a valid email address in order to claim the prize.

4.5 The prize is personal to the winner and can’t be gifted, transferred or sold and no cash alternative is offered. Gift cards will be subject to Gymshark’s Terms and Conditions of Sale applicable in the winner’s jurisdiction of residence.

4.6 We reserve the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond our control make it necessary to do so.

5. HOW IS A WINNER SELECTED?

5.1 A winner will be selected by random draw performed by a computer process.

5.2 Our decision regarding any aspect of the giveaway is final and binding and no correspondence will be entered into about it.

5.3 The winner will be notified via email in a reasonable time following the closing date.

5.4 We will make all reasonable efforts to contact the winner. If the winner does not respond to email within 30 days of being notified by us, then they will forfeit their prize and we may offer the prize to the next eligible entrant.

5.5 We must either publish or make available information that indicates that a valid award took place. To comply with this obligation, we will send the surname and county of the winners to anyone who emails a request to socialcomps@gymshark.com within 1 month after the closing date.

5.6 If you have an objection to any or all of your surname and county being published or made available, please email us at socialcomps@gymshark.com. In such circumstances, we must still provide the information to the relevant authority on request.

5.7 We reserve the right to withdraw the prize (or any part of it) if a winner breaches any of these terms and conditions or if they are found to have acted in a dishonest or fraudulent manner.

6. PUBLICITY & DATA PROTECTION

6.1 We may re-post, re-tweet, publicise and otherwise use any text, photographs, graphics, video or audio or any other materials that you post in relation to the giveaway (including as part of the entry process or as part of a prize) or if you tag or mention @Gymshark in any such content, whether via the same platform that you posted or shared the content, as well as via other social media platforms that we use, and on our websites. We will contact you should we wish to do this.

6.2 If you are a winner, we will contact you with further details if we want to get you involved in any publicity and/or events that we have planned.

6.3 We will only process your personal data in accordance with our Privacy Notice which you can read at https://uk.gymshark.com/pages/gymshark-privacy-notice and as set out in these terms and conditions with regard to the announcement of the winner and fulfilment, delivery and arrangement of the prize.

7. LIMITATION OF LIABILITY

Insofar as is permitted by law, we, our affiliates, agents, distributors, representatives and/or employees will not in any circumstances be responsible or liable to compensate any winner or accept liability for any loss, damage, personal injury or death occurring as a result of taking part in this giveaway and/or taking up the prize except where it is caused by our negligence or the negligence of our affiliates, agents, distributors, representatives and/or that of our employees. Your statutory rights are not affected.

8. GENERAL

8.1 If there is any reason to believe that there has been a breach of these terms and conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the giveaway.

8.2 We reserve the right to hold void, suspend, cancel, or amend the giveaway where it becomes necessary to do so. The giveaway shall be void where prohibited by local laws or regulations, including where in our reasonable opinion we cannot accept an entry or provide a prize due to sanctions laws or banking restrictions. It is the responsibility of entrants to ensure that they are able to participate in the giveaway in compliance with local laws and regulations. To the fullest extent permitted by law, we are not liable where an entrant has breached local laws and/or regulations in connection with the giveaway.

8.3 These terms and conditions will be governed by laws of England and Wales.

8.4 We and you each agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
