Terms & Conditions

For two hours only we’re giving away up to $250,000 USD* (two hundred and fifty thousand US dollars) worth of Gymshark gift cards (*or local currency equivalent as set out below) for free on Gymshark.com or via the Gymshark app (excludes UAE, Kuwait, Oman and Bahrain sites). Limited number of gift cards available. Gift cards will be awarded randomly following the closing time. See T&C’s below.

By taking part in this giveaway, you agree to be bound by these terms and conditions. If you do not agree with any of these terms and conditions, then you should not take part in this giveaway.

1. THE GIVEAWAY

1.1 The promoter is Gymshark Ltd of GSHQ Blythe Valley Park, 3 Central Boulevard, Solihull, United Kingdom, B90 8AB (“we”, “us”, “our”).

1.2 The giveaway is free to enter.

1.3 Only one entry will be accepted per person. Multiple entries from the same person will not count as additional entries.

1.4 This giveaway is in no way sponsored, endorsed, administered by or associated with any social media platforms on which this giveaway is advertised and by participating in this giveaway you agree to a complete release of these social media platforms from any claims arising out of or in connection with this giveaway.

2. HOW TO ENTER

2.1 To enter the giveaway, you must:

2.1.1 visit Gymshark.com or the Gymshark app;

2.1.2 add a $0 (nil value) gift card (SKU: GIVEAWAY-ENTRY) to your shopping basket;

2.1.3 proceed to checkout; and

2.1.4 complete your order between 18:00 GMT on 22 November 2024 (“opening time”) and 20:00 GMT on 22 November 2024 (“closing time”).

2.2 Entries that are early, late, lost, delayed, misdirected, incomplete or cannot be delivered or entered for any reason will not be accepted. If for any reason a technical interruption, fault or site failure occurs when purchasing online, we do not take any responsibility for incomplete purchases and any incomplete purchases will not be considered valid for entry into the giveaway. We accept no responsibility for any purchases which are not completed for any reason.

3. ELIGIBILITY

3.1 Entrants must be aged 18 years or over to participate in the giveaway.

3.2 We reserve the right to ask any winner to provide proof of age.

3.3 Our employees (and their immediate family) and those of our group companies, or anyone directly associated with us or the administration of the giveaway, are not eligible to enter the giveaway.

3.4 Entrants must have a valid email address to participate in the giveaway. Entrants without a valid email address will not be entered into the draw.

3.5 Entrants must also reside within countries eligible to receive deliveries from us – if you reside within a country in which we cannot deliver, you are ineligible to participate in the giveaway. You can find this information here. Entrants resident in the UAE, Kuwait, Oman and Bahrain are not eligible to enter this giveaway.

3.6 In entering the giveaway, you confirm that you are eligible to do so and eligible to claim any prize you may win.

3.7 We reserve all rights (at our sole discretion) to decide if the eligibility criteria are met and/or to disqualify you from the giveaway if: (i) your conduct is contrary to the spirit or intention of the giveaway, or (ii) in our opinion you've breached any of these terms and conditions.

4. PRIZE

4.1 There are a total of 11,995 (eleven thousand nine hundred ninety-five) gift vouchers of varying value available to be won as follows:

4.2 11,995 (eleven thousand nine hundred ninety-five) randomly selected entrants will receive a Gymshark gift card(in the form of a digital code) up to the maximum value of $1,000 USD (one thousand US dollars), or local currency equivalent (as set out above) if the winner resides outside of the USA.

4.3 Gift card value will be determined randomly by a computer process.

4.4 Winners will be notified via email within 24 hours following the closing time. Each prize is subject to winner confirmation (i.e. we can contact the winner and can confirm eligibility). Winners must also provide us with their full name, a valid postal address and a valid email address in order to claim the prize. Winners should allow up to 24 hours after being notified of their win for delivery of their gift card by email.

4.5 Each prize is personal to the winner and can’t be gifted, transferred or sold and no cash alternative is offered. Gift card usage will be subject to Gymshark’s Terms and Conditions of Sale. Gift cards will not be valid for use on Gymshark’s UAE, Kuwait, Oman and Bahrain sites.

4.6 We reserve the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond our control make it necessary to do so.

5. HOW ARE THE WINNERS SELECTED?

5.1 Winners will be selected by a random draw performed by a computer process.

5.2 Our decision regarding any aspect of the giveaway is final and binding and no correspondence will be entered into about it.

5.3 We will make all reasonable efforts to contact winners using the contact details provided at the time of entry. If a winner cannot be contacted or the prize cannot be delivered by email to a winner within 30 days of being notified by us, then they will forfeit their prize and we may offer the prize to the next eligible entrant.

5.4 We must either publish or make available information that indicates that a valid award took place. To comply with this obligation, we will send the surname and county (or state) of residence of major prize winners (defined as winners of gift cards with a value of $100.00 USD (or local currency equivalent as set out above) or above) to anyone who emails a request to socialcomps@gymshark.com within 1 month after the closing date.

5.5 If you have an objection to any or all of your surname and county (or state) of residence being published or made available, please email us at socialcomps@gymshark.com. In such circumstances, we must still provide the information to the relevant authority on request.

5.6 We reserve the right to withdraw the prize (or any part of it) if a winner breaches any of these terms and conditions or if they are found to have acted in a dishonest or fraudulent manner.

6. PUBLICITY & DATA PROTECTION

6.1 We may re-post, re-tweet, publicise and otherwise use any text, photographs, graphics, video or audio or any other materials that you post in relation to the giveaway (including as part of the entry process or as part of a prize) or if you tag or mention @Gymshark in any such content, whether via the same platform that you posted or shared the content, as well as via other social media platforms that we use, and on our websites. We will contact you should we wish to do this.

6.2 If you are a winner, we will contact you with further details if we want to get you involved in any publicity and/or events that we have planned.

6.3 We will only process your personal data in accordance with our Privacy Notice which you can read at https://uk.gymshark.com/pages/gymshark-privacy-notice and as set out in these terms and conditions with regard to the announcement of the winners and fulfilment, delivery and arrangement of the prize.

7. LIMITATION OF LIABILITY

Insofar as is permitted by law, we, our affiliates, agents, distributors, representatives and/or employees will not in any circumstances be responsible or liable to compensate any winner or accept liability for any loss, damage, personal injury or death occurring as a result of taking part in this giveaway and/or taking up the prize except where it is caused by our negligence or the negligence of our affiliates, agents, distributors, representatives and/or that of our employees. Your statutory rights are not affected

8. GENERAL

8.1 If there is any reason to believe that there has been a breach of these terms and conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the competition.

8.2 We reserve the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. The giveaway shall be void where prohibited by local laws or regulations, including where in our reasonable opinion we cannot accept an entry or provide a prize due to sanctions laws or banking restrictions. It is the responsibility of entrants to ensure that they are able to participate in the giveaway in compliance with local laws and regulations. To the fullest extent permitted by law, we are not liable where an entrant has breached local laws and/or regulations in connection with the competition.

8.3 These terms and conditions will be governed by laws of England and Wales.

8.4 We and you each agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
