HOW TO ENTER:

To enter, purchase a Gymshark product from selected lines from 4:00pm (UK time) on Friday 18th October 2024 to 11:59pm (UK time) on Thursday 31st October 2024 at uk.gymshark.com or via the Gymshark App (with the UK as the browsing country) to be eligible to enter the draw.

Terms and Conditions

By taking part in this prize draw, you agree to be bound by these terms and conditions. If you do not agree with any of these terms and conditions, then you should not take part in this prize draw.

1. THE PRIZE DRAW

1.1 The promoter is Gymshark Ltd of GSHQ Blythe Valley Park, 3 Central Boulevard, Solihull, United Kingdom, B90 8AB (“we”, “us”, “our”).

1.2 Upon purchase of any of the following Gymshark products you will be automatically entered into the prize draw, subject to availability online:

1.3 There is a limit of one entry to the prize draw per person.

1.4 By participating in this prize draw you agree to a complete release of Columbia TriStar Marketing Group, Inc. and its affiliates from any and all liability arising out of or in connection with this prize draw.

2. HOW TO ENTER

2.1 To enter the prize draw you must, during the Entry Window (as defined in paragraph 2.3 below), purchase, in one visit/session, a Gymshark item from the selected lines listed above from the UK online store at uk.gymshark.com or via the Gymshark App (with the UK as the browsing country).

2.2 Entries that are late, lost, delayed, misdirected, incomplete or cannot be delivered or entered for a technical or other reason will not be accepted.

2.3 The period for valid entries to be submitted will be 4:00pm (UK time) on Friday 18th October 2024 to 11:59pm (UK time) on Thursday 31st October 2024 (“Entry Window”). Entries received outside of the Entry Window will not be considered for the prize draw.

2.4 If for any reason a technical interruption, fault or site failure occurs when purchasing online, we accept no responsibility for incomplete purchases and any incomplete purchases will not be considered valid for entry into the prize draw. We accept no responsibility for any purchases which are not completed for any reason.

3. ELIGIBILITY

3.1 Entrants must be aged 18 years or over to participate in the prize draw. We reserve the right to ask any winner to provide proof of age.

3.2 Our employees (and their immediate family) and those of our group companies, or anyone directly associated with us or the administration of the prize draw, are not eligible to enter the prize draw.

3.3 Entrants must have a valid email address to participate in the prize draw.

3.4 Entrants must reside in the UK (the prize draw is not open to people residing outside the UK).

3.5 In entering the prize draw, you agree and hereby confirm that: (i) your entry is original, has not been copied and/or does not otherwise infringe the intellectual property or other rights of any third party, and (ii) your entry does not cause, or is unlikely (in our reasonable opinion) to cause distress and/ or offense to any person, group of people and/or the public.

3.6 In entering the prize draw, you confirm that you are eligible to do so and eligible to claim any prize you may win.

3.7 We reserve all rights (at our sole discretion) to decide if the eligibility criteria are met and/or to disqualify you from the prize draw and remove your entry post if: (i) your conduct is contrary to the spirit or intention of the prize draw; or (ii) in our opinion you've breached any of these terms and conditions.

4. PRIZE

4.1 There is one prize available supplied by a third party, Element, that includes:

a. Return flights from London, UK to Las Vegas, Nevada, USA.

b. Return airport transfers in Las Vegas only.

c. 3 nights’ accommodation in Las Vegas, based on sharing a double occupancy room, with breakfast.

d. Activities include a Canyon Rim Horseback Ride, Las Vegas Helicopter Night Flight, Private 3-Wheel Motorcycle Ride, Supercar Driving Experience and one All-You-Can-Eat Buffet, each subject to availability at the time of booking.

e. Travel Insurance.

4.2 The prize does not include the cost of transfers in the UK, food and drink (unless expressly stated), spending money, tax or other personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.

4.3 All travel must be completed by 18 October 2026 and travel date exclusions may apply.

4.4 The prize is supplied by Element. Exact arrangements for the above prizes shall be discussed between Gymshark, the winner and Element after the winner has been selected.

4.5 Winners will be responsible for ensuring that they and any person travelling with them are available to travel and hold valid passports, any necessary visas and travel documents for the travel in question on the travel dates specified.

4.6 The prize is subject to winner confirmation (i.e. we can contact the winner and can confirm eligibility). The winner must also provide us with their full name, a valid postal address and a valid email address (if not already provided) in order to claim the prize.

4.7 The prize is personal to the winner and can't be gifted, transferred or sold and no cash alternative is offered.

4.8 Prizes are subject to availability at the time of booking. We reserve the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond our control make it necessary to do so, or if any of the prizes set out above are not for sale in the countries in which any of the winners reside/are based.

5. HOW IS A WINNER SELECTED?

5.1 A winner will be selected by random draw performed by a computer process.

5.2 Our decision regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.

5.3 The winner will be notified via email or telephone shortly following the closing date.

5.4 We will make all reasonable efforts to contact the winner. If the winner does not respond to the direct message within 21 days of being notified by us, then they will forfeit their prize and we may offer the prize to the next eligible entrant.

5.5 We must either publish or make available information that indicates that a valid award took place. To comply with this obligation, we will send the surname and county of the winner to anyone who emails a request to socialcomps@gymshark.com within 1 month after the closing date.

5.6 If you have an objection to any or all of your surname and county being published or made available, please email us at socialcomps@gymshark.com. In such circumstances, we must still provide the information to the relevant authority on request.

5.7 We reserve the right to withdraw the prize (or any part of it) if a winner breaches any of these terms and conditions or if they are found to have acted in a dishonest or fraudulent manner.

6. PUBLICITY & DATA PROTECTION

6.1 We may re-post, re-tweet, publicise and otherwise use any text, photographs, graphics, video or audio or any other materials that you post in relation to the prize draw (including as part of the entry process or as part of a prize) or if you tag or mention @Gymshark in any such content, whether via the same platform that you posted or shared the content, as well as via other social media platforms that we use, and on our websites. We will contact you should we wish to do this.

6.2 If you are a winner, we will contact you with further details if we want to get you involved in any publicity and/or events that we have planned.

6.3 We will only process your personal data in accordance with our Privacy Notice which you can read at https://uk.gymshark.com/pages/gymshark-privacy-notice and as set out in these terms and conditions with regard to the announcement of the winner and fulfilment, delivery and arrangement of the prize.

7. LIMITATION OF LIABILITY

Insofar as is permitted by law, we, our affiliates, agents, distributors, representatives and/or employees will not in any circumstances be responsible or liable to compensate any winner or accept liability for any loss, damage, personal injury or death occurring as a result of taking part in this prize draw and/or taking up the prize except where it is caused by our negligence or the negligence of our affiliates, agents, distributors, representatives and/or that of our employees. Your statutory rights are not affected.

8. GENERAL

8.1 If there is any reason to believe that there has been a breach of these terms and conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the competition.

8.2 We reserve the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

8.3 These terms and conditions will be governed by the laws of England and Wales.

8.4 We and you each agree to submit to the non-exclusive jurisdiction of the courts of England and Wales.
