These are the terms and conditions on which we supply our products to you.
Please read these terms carefully before ordering with us. These terms tell you what you need to know about buying with us. If you think that there might be a mistake in these terms, please let us know. We may revise these terms and conditions without notice by posting revised terms and conditions of sale on our website. The terms and conditions posted on the website or app at the time you place your order will govern that purchase.
1. Who we are and how to contact us
1.1 Who are we? We are Gymshark EU B.V. – a company registered in the Netherlands with company number 94672288. Our head office is at De Boelelaan 30, 1083 HJ, Amsterdam, The Netherlands. Our registered VAT ID No. is NL866854873B01.
1.2 How to contact us. You can contact us at gymshark.com/contact and/or via the support section on our e-comm app (known as the Gymshark App on the App Store) (the “app”).
1.3 How we may contact you. If we have to contact you, we will send an email to the email address you provided to us in your order.
2. Placing an order
2.1 How do I place an order? Orders are placed through our website or our app. Once you have added the desired product(s) to your shopping cart, you will go through our checkout process, where you will need to enter your contact details and delivery/billing details. Please check your order very carefully (e.g. the product(s), size(s) and delivery address) before clicking on the "Complete order" button or the "Pay now" button.
2.2 Acceptance of your order. Your order is an offer from you to us to purchase the product(s) in your shopping cart. After you have placed an order, you will receive an email from us confirming that we have received the order. Our official acceptance of your order will be when we send you an email to confirm that we have dispatched your product(s). At this moment, a contract is concluded between you and us. When confirming your order, we will also confirm your order number. Please quote this number if you want to contact us about your order, you must provide this number.
2.3 Restrictions on order placement. To order our products, you must be at least 18 years of age and eligible to use your chosen payment method to pay for the products you order. If you are under 18 years of age, you may only place an order if a parent or guardian is involved.
3. Our rights to cancel your order
3.1 If we are unable to fulfill your order. In the unlikely event that we are unable to fulfil your order (for example, because the product is out of stock, because we are unable to verify the billing information you have provided, because you have requested delivery to a country to which we do not currently deliver, or because there has been an error in the pricing or description of the product), We will inform you of this by email and will not charge you for the product.
3.2 Unusual or suspicious activity. We supply our products for personal use only. If we notice anything unusual or suspect that our products are being used for commercial, business or resale purposes, we may cancel an order. If this happens to you and you believe we have made a mistake, please contact our customer service team via our online form on gymshark.com/contact and/or via the support section in our app.
3.3 Suspend the delivery of products. We may have to suspend the delivery of a product because:
3.3.1 We have technical problems or need to make minor technical changes;
3.3.2 We need to update the product to reflect changes in relevant laws and regulatory requirements. or
3.3.3 We need to make changes to the product that have been notified to you by us.
4. Our products
4.1 What we deliver. We supply fitness equipment, including clothing and accessories.
4.2 Description of our products. The images of our products (and their packaging) on our website and app are for illustrative purposes only. We do our best to ensure that the colors are displayed accurately, but we cannot guarantee that the colors displayed on a device will exactly match those of our products.
4.3 Gift cards. You can buy an e-gift card (in the form of a digital code) from us in the same way as any of our other products, but:
4.3.1 You can't buy a gift card with another gift card as a form of payment.
4.3.2 Gift cards are valid for 24 months from the date of purchase; and
4.3.3 Gift cards can only be redeemed in the local online store where they were purchased (e.g. gift cards purchased from fi.gymshark.com or through our app with Finland as the country where the search was made can only fi.gymshark.com in the store or through our app with Finland as the country where the search was made, be redeemed).
Please note: Gift vouchers are not valid for use in our shop in the Kalverstraat.
5. Delivery
5.1 Destination of the shipment. Unfortunately, we do not currently ship to the following countries https://support.gymshark.com/fi/article/delivery-information
5.2 Shipping costs. Your order will incur shipping costs. All information about our shipping costs can be found here: https://support.gymshark.com/fi/article/delivery-information
5.3 Additional costs. Any duties, import duties or additional charges incurred on your order (e.g. for delivery outside the UK) are your responsibility and are not included in the delivery charges.
5.4 When we deliver the products. When we deliver your products depends on the shipping method you select during the checkout process. 5.5 We are not responsible for delays that are beyond our control. If the delivery of your products is delayed due to an event beyond our control (e.g. postal/courier delays, logistics or bad weather delays), we will inform you as soon as possible. If there is a risk of significant delay, you can contact us to cancel your order and we will refund any products you paid for but did not receive.
5.6 If you are not available at the time of delivery of the product. If no one is able to take delivery and the products do not fit in your mailbox, the courier will notify you of the delivery attempt and let you know where to pick up your order or how to have it delivered.
6. Your rights to end the contract
6.1 You can terminate the contract with us at any time. Your rights when you cancel the contract depend on what you have purchased, whether there is anything wrong with it, how we operate and when you decide to cancel the contract, as described below. We are required by law to supply products that comply with this Agreement and nothing in these Terms affects your statutory rights.
6.2 If what you have bought is faulty or differs substantially from how it is described on our website or our app you may have a legal right to end the contract (or to get the product replaced or to be given a refund). In this case, the return will be free in Finland provided you return the product to us within 30 days (unless stated otherwise on our website or our app) from the date you receive it.
6.3 If you wish to cancel the contract for any of the reasons listed below, the contract will be terminated immediately and we will refund you the full amount for any products you have paid for but not delivered to you. The reasons may be that:
6.3.1 we have notified you of upcoming changes to the Product or these Terms that you do not agree with;
6.3.2 We have informed you of an error in the price or description of the product you have ordered that prevents you from purchasing it;
6.3.3 We have informed you of a significant delay in the delivery of the products due to events beyond our control.
6.3.4 We have suspended the delivery of the Products for technical reasons or informed you that we will suspend them for technical reasons, in any case for a period of more than four weeks; or
6.3.5 You have the legal right to cancel the contract because of a mistake we have made wrong.
6.4 If you have changed your mind about the product. We offer a goodwill guarantee that gives you 30 days (unless otherwise stated on our website or app) to change your mind and receive a refund instead of the usual 14 days (which does not affect your legal rights in relation to defective products). The 30-day cooling-off period (unless otherwise stated on our website or app) starts as soon as you (or a person nominated by you) receive the products. If your order is split into different deliveries arriving on different days, your 30-day cooling-off period (unless otherwise stated on our website or app) will start after the day you (or a person nominated by you) received the last delivery. In both cases, you may be required to pay the cost of return shipping as described in our https://support.gymshark.com/fi/category/returns-and-refunds return procedure .
Please note that some products cannot be returned and there is no right to change your mind and receive a refund for these products, such as:
6.4.1 swimwear, underwear, bottles and shakers due to health, safety and hygiene standards;
6.4.2 Products that have been sealed for health protection or hygiene (e.g. socks), that have not been sealed upon receipt or that are not in their original packaging or from which the labels or hygiene strip have been removed;
6.4.3 Goods that are tailor-made or personalised;
6.4.4 Products that have been damaged, worn or otherwise used, or where the care label has been cut off and/or removed;
6.4.5 Products that are missing parts when you return them (unless this is the result of an action taken by us); and
6.4.6 Products that are inseparably mixed with other items after delivery.
6.5 In the event that a product is damaged by you or a part is missing when you return it, we may hold you liable for the depreciation of the product if your handling of the product goes beyond what was necessary to determine the nature, characteristics and functioning of the product.
7. Returns and refunds
7.1 Let us know that you want to cancel the contract. To cancel the contract with us, ask us questions or in the unlikely event that you have any complaints about the product, please let us know by contacting our customer service team via our online form on gymshark.com/contact, via live chat, via the support section or via any of the other options on our website or app. Please include your name, shipping address, order number, and email address so we can help you quickly and easily.
7.2 Return of products after termination of the contract. If you cancel the contract for any reason after the products have been shipped to you or you have received the products, you must return them to us. The return process is described in our Return Policy. Visit our returns portal on https://support.gymshark.com/fi/article/how-do-i-return-my-items or via our app, enter the required information (including details of the product(s) you are returning and the reason(s) for the return) and follow the relevant instructions, including (if provided) printing a return label. If you exercise your statutory right of withdrawal, you can choose to fill in the legally required withdrawal form, which you can request, fill in and return by email to the following address: support@gymshark.com. However, you may still need to complete your return via our returns portal. You will then need to drop off the package with the products you are returning (with the return label securely attached) at one of the collection points we have given you. Unless otherwise stated on our website or app, you must ensure that the products are returned to us within 30 days of delivery.
7.3 How and when we will refund you the purchase price. We will refund the amount you paid for the Products (including delivery charges, if applicable) to the original payment method. For purchases paid partly by card and partly by gift card, the refund will be applied to the gift card first. If you used a discount code when making the payment, the amount to be refunded will be reduced to take into account the benefit of the discount you received when you purchased the product. We will refund you as soon as possible. If you exercise your right of withdrawal, your refund will be made within 14 days from the day we received the product back from you.
8. Our rights to terminate the contract
8.1 We can terminate the contract if you break it. We may terminate the contract for a Product at any time in writing if:
8.1.1 You do not provide us with the information necessary to provide the Products, such as the delivery address, within a reasonable period of time after our request; or
8.1.2 They do not allow us to deliver the products to you within a reasonable timeframe.
8.2 Refunds. If we cancel the contract in the situations set out in the clause Error! Reference source not found., we will refund all the money you paid us for products that we did not deliver.
9. Price and payment
9.1 Where can you find the price of the product? The price of the product (including VAT) is the price displayed on the order pages when you place your orderor, in the case of our physical stores, displayed on the products. We make sure that the price of the product recommended to you is correct. However, please note the clause 9.4 What happens if we detect an error in the price of the product you ordered? We offer alternative payment options with Klarna. 9.2 We will pass on any changes to the VAT rate. If the VAT rate changes between the date of your order and the date we deliver the product, we will adjust the VAT rate you pay, unless you have already paid for the product in full before the VAT change takes effect.
9.3 We may change the price of our products. Sometimes we need to adjust the price of some of our products. In this case, we will adjust the prices on our website, in our app and in our stores . If you placed your order for a product before the price change, the price will be set out on our website or app (as applicable) at the time of your order.
9.4 What happens if we quote an incorrect price? It is always possible that, despite our best efforts, some of the products we sell have an incorrect price. We usually check the prices before accepting your order, and then if the correct price of the product on the order date is lower than the price we quoted on the order date, we will charge the lower amount. If we accept and process your order where a pricing error is obvious and obvious and could reasonably have been recognised by you as a pricing error, we may cancel the contract, refund you the amount paid and require the return of all products supplied to you.
9.5 When and how to pay. We accept payments via Visa, Mastercard, American Express, PayPal, iDEAL and Apple Pay. We will not charge you any fees until we have dispatched the Products to you, although the price payable for your Products may appear as pending transactions on the payment method you use.
We also offer you the opportunity to make your purchase at Klarna Bank (AB) (publ.).

Please note that we reserve the right to withdraw or suspend this opportunity with Klarna at any time at our sole discretion.
10. Discount codes
10.1 From time to time, we will publish discount codes ("Codes") via email or other marketing channels. These codes can be used to apply a discount to a new order at fi.gymshark.com. To apply a code, you can enter it in the indicated place during the checkout process (and don't forget to click "Apply").
10.2 Please note:
10.2.1 The codes are valid for a limited period of time, as indicated in the relevant email or marketing communication, and cannot be used outside of this period.
10.2.2 Unless expressly stated in the relevant email or marketing communication, codes can only be used on full-price items and are not intended for items that are on sale or on sale or for the purchase of gift cards.
10.2.3 Only one code can be applied per order. Codes cannot be used in conjunction with any other offer and are not available to employees of Gymshark or any of its group companies.
10.2.4 Codes are specific to an area or store, cannot be exchanged for cash, and are non-transferable.
10.2.5 Codes do not affect shipping costs.
10.2.6 Returned items will be refunded at the discounted price paid (the discount will be distributed proportionately among the products). If an order is placed with a total amount for which the discount code can be used, and items purchased with the code are later returned to us, causing the order amount to fall below the level required for the discount code, the offer value may be deducted from any refund. This does not affect your statutory rights. No discount will be applied to items that are replaced later. Orders are subject to available stock and acceptance by us. We reserve the right to refuse orders if, in our reasonable opinion, a code is not eligible for the order or is the subject of improper use or fraudulent activity.
10.2.7 Orders are subject to stock availability and acceptance by us. We reserve the right to decline to accept orders where, in our reasonable opinion, a Code is invalid for the order being placed or is the subject of improper use or fraudulent activity.
10.2.8 We reserve the right to withdraw, modify or extend offers at any time with reasonable notice.
10.3 Specific terms and conditions of the offer are indicated with each code. Specific information relevant to this Code can be found in our emails or marketing communications.
11. Our responsibility for loss or damage suffered by you
11.1 We will be liable to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we will be responsible for any loss or damage you suffer that is a foreseeable consequence of our breach of this contract or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is clear that it will occur, or if, at the time the contract is concluded, both we and you knew that it might occur.
11.2 We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or contractors; for fraud or fraudulent misrepresentation; for infringement of your legal rights in relation to the Products (including the right to receive Products that are as described and conform to the information we have provided to you, which are of satisfactory quality, fit for any particular purpose notified to us, and have been provided with reasonable skill and care); and for broken products.
11.3 We are not liable for lost profits. We supply the products for personal use only. If you use the Products for commercial, business or resale purposes, we will not be liable to you for any loss of profits, loss of business, business interruption or loss of business opportunity.
12. How we may use your personal information

13. Other important terms
13.1 We may transfer this Agreement to another person. We may transfer our rights and obligations under these Terms to another organization. We will contact you to let you know if we plan to do this. If you do not agree to this transfer, you may contact us to cancel the contract within seven days of our notification. We will then refund any payments you have made in advance for undelivered products.
13.2 You need our permission to transfer your rights to another person. You may only transfer your rights or obligations under these Terms to another person if we agree to this in writing.
13.3 Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
13.4 We may change these terms at any time. We may make changes to these terms at any time to reflect changes in the law or for any other reason. The most up-to-date version of our terms will always be displayed on our website and/or our app so please have a look before placing an order for our products to ensure you know about any changes which may have been made since your last visit to our website or our app.
13.5 If a court finds any part of this Agreement to be unlawful, the remainder will remain in effect. Each of the sections of these Terms and Conditions has a separate effect. If a court or competent authority decides that any of these paragraphs are unlawful, the remaining paragraphs shall remain in full force and effect.
13.6 If we have not yet executed the contract, we may do so at a later date. If we do not insist immediately that you do anything that you are required to do under these Terms, or if we delay in taking action against you in relation to your breach of contract, that does not mean that you do not have to do those things and it will not prevent us from taking action against you at a later date.
13.7 What laws apply to this contract and where can you take legal action? These Terms and Conditions are governed by English law. You may take legal action in relation to the Products in the English courts. If you live in Finland, you can file a court case regarding the products with the competent Finnish court or the English court. If we take legal action against you, we will take them to the English courts. Within one month after we have invoked this provision, you have the right to opt for dispute resolution by a competent Finnish court.
14. Additional terms and Conditions that apply when buying from our store in Kalverstratt
Returns and Refunds:
1. With the exception of personalized products, our goodwill return policy means that you can return your item in-store within 30 days of the date of purchase. Return the item unused, with the packaging and labeling intact, and with your original receipt or e-receipt and we will refund the price you paid for the products using the method you used for payment. If you used a discount code when purchasing the product, the refunded amount will be reduced to take into account the benefit of the discount you received when you purchased the product. If a refund is not possible using the method you used for payment, you can exchange the item for an item of the same price (subject to in-store availability).
2. Our goodwill return policy does not apply to products that fall into the categories set out in clauses 6.4.1 to 6.4.6 above, including items that we have personalised for you, or items that are sealed for health protection or hygiene purposes once they are unsealed after purchase.
3. Products purchased through our website or app, or at another Gymshark location, cannot be returned to our store in Kalverstraat.
4. Products purchased from our store on Kalverstraat can only be returned to our store on Kalverstraat.
5. Legal rights: Our right of return does not affect the legal rights you have as a consumer.
